SN In a drug or alcohol context, a treatment or re-education program for cases referred from criminal courts (criminal diversion), whether charged with driving under the influence of alcohol (drinking-driver diversion), another drug offense (drug diversion), or a general crime not defined in terms of drugs or alcohol. In strict legal usage of the term, cases are assigned to a diversion program in lieu of prosecution, which is usually held in abeyance pending successful completion of the diversion program. "Diversion" also is used more broadly for any pattern of referral from the court at any stage of processing, including as a sentence or condition of probation.
A disposition of a criminal defendant, either before or after adjudication of guilt, in which the court directs the defendant to participate in a work or education program as part of probation.
